Background
Garlough et al v. FCA US LLC is a putative class action filed on behalf of individuals who purchased or leased the limited-edition 2018 Dodge Challenger SRT Demon (“Dodge Demon”). The Dodge Demon was marketed as a one-of-kind vehicle and featured on popular car shows such as Topgear and Jay Leno's Garage.
The suit alleges that the Dodge Demon suffers from a defective and/or nonconforming hood scoop that warps, bulges, and buckles, and in turn, strips, cracks and chips the vehicle's original factory paint. In addition, the suit alleges that despite knowing of these issues, FCA US LLC continued to market the Dodge Demon as a high-end vehicle with features that were designed to build upon the vehicle's future collectability. To date, FCA US LLC has offered an inadequate replacement hood scoop insert, which, as alleged, will substantially impact the vehicle's value and future collectability, and is otherwise a significant departure from the vehicle as advertised.
Prior to and even after the offered “fix” in December 2019, Dodge Demon owners spent an inordinate amount of time and resources attempting to persevere the value of the vehicle, including custom paint jobs and purchasing carbon inserts. Ultimately, however, owners have been unable to enjoy the use of the Dodge Demon as was advertised and will continue to be sidelined unless and until FCA US LLC offers an acceptable fix.
